Background & Purpose

When you moved into your townhouse, you agreed to abide by the Articles of Incorporation, Declaration (CC&Rs), and By-laws of the Desert Palms Townhouse Association. These supplementary Rules and Regulations provide guidelines so all residents may enjoy the community and protect property investments. Residents are asked to observe them out of respect and courtesy to their neighbors.


Violations and Fines

Violation of these Rules, CC&Rs, Bylaws, or Articles may result in a $50.00 fine per unresolved violation.

  1. First Notice: An owner receiving a “Notice of Violation (Friendly Reminder)” may respond to Management in writing within 10 days. The Association will provide the specific provision violated, the date observed, the reporter’s name, and the contest process.

  2. Second Notice: If unresolved within 30 days of the original notice, a “Second Notice with Intent to Fine” is sent. The owner has 21 days to request a hearing in writing.

  3. Third Notice: Issued within 30 days of the second notice; a $50 fine is applied.

  4. Ongoing Violations: An additional $50 fine may be imposed every 30 days the violation persists. Other penalties include loss of voting rights and exclusion from pool usage.


Meetings

  • Annual Meeting: Held on the third Tuesday of January each year. Notice and absentee ballots (for those unable to attend) are sent by mail in advance.

  • Board Meetings: Prior notice is posted at the pool area.


Property Lines & Maintenance

  • North Side: Property extends 106 feet from the street to the “apron” connecting the carport/garage to the alley.

  • South Side: Lots extend 114 feet (approx. 3 feet beyond the outer wall). Owners are responsible for maintaining the alley and the 3 feet beyond the wall.

  • Easements: A 10-foot easement exists behind patio walls for utility lines and maintenance.


Responsibilities of Ownership

  • Assessments: Monthly maintenance is due on the 1st and delinquent by the 15th. No statements are sent.

  • Payment Methods: Checks payable to Desert Palms Townhouse Association can be mailed to management or placed in the locked box at 8908 E. Palms Park Dr. Electronic payments are also accepted.

  • Late Fees: $10.00 for the first month and $10.00 for each subsequent month. A lien is placed after 3 consecutive months of delinquency.

  • Assessment Increases: Limited to 15% per year without a membership vote.


General Conduct

  • Speed Limit: Maximum 10 mph on East Palms Park Drive.

  • Soliciting/Trespassing: Prohibited on private roads and property.


Parking Rules

  • Street/Curb: No parking at the east and west ends of the streets. Do not block driveways or mailboxes.

  • Front Yards: NO PARKING ON THE FRONT YARD AT ANY TIME.

  • Carports: Vehicles must be pulled completely in so the rear does not extend into the street.

  • Alleys (South Side): Residents may park in the alley behind their unit but must not obstruct traffic or emergency vehicles. Vehicles cannot be stored indefinitely.

  • Prohibited Vehicles: Commercial vehicles, trailers, campers, boats, or construction equipment are prohibited unless kept orderly within a garage or carport.

  • Motor Homes: Permitted for a maximum of two or three weeks.

  • Towing: Vehicles in violation may be towed at the owner’s/tenant’s expense.


Landscaping Rules

  • Maintenance: Landscapers are not responsible for owner-planted flowers/shrubs. Homeowners may not alter irrigation settings.

  • Removal/Replacement: Dead trees/shrubs (as determined by the committee) are replaced by the Association at no cost. Stump removal is at the owner’s expense. Homeowners must not trim or remove plants maintained by Association landscapers without Board approval.

  • Private Projects: Must use qualified landscapers and be completed within 30 days. Requests must be submitted to the Property Manager.


Exterior Lighting & Mailboxes

  • Requirements: Front and rear lights (including house numbers and post lamps) must be illuminated during darkness.

  • North Side: Must maintain a functioning spotlight on the garage/carport (dusk to dawn).

  • Maintenance: The Association replaces standard bulbs. Non-functional lights should be reported to management.

  • Mailboxes: Inspected and repaired/replaced by the Association as needed.


Pool Rules

  • Access: Exclusive to residents and guests. Gates must remain closed and locked at all times (State Law).

  • Supervision: Adults must supervise all children 17 and under. Children 6 and under require 1-to-1 supervision.

  • Prohibitions: No glass, no animals, no boisterous conduct/running. Proper attire is required (no cutoffs); babies must wear “swimmers.”

  • Keys: Two keys issued per owner. Replacements cost $25.00.

  • Parties: Must be scheduled with Management. A refundable $75.00 fee is required.

  • Safety: No lifeguard on duty—swim at your own risk.


Vacating & Rentals

  • Temporary Absence: Provide Management with the contact info of a key-holder for emergency inspections. Do not turn off electricity (exterior lighting is required).

  • Sale or Lease: Owners must provide tenants with all governing documents and notify management (Bidegain Realty) of lease agreements and vehicle info. Owners are responsible for tenant behavior.


Architectural Control & Pets

  • Structural Changes: Written consent from the Architectural Committee is required prior to any alterations.

  • Inspections: The exterior of properties is inspected yearly.

  • Pets: Weight limit of 35 pounds. Maximum of two small domestic pets. Dogs must be leashed; cats must be confined to the owner’s property. Owners must clean up after pets in all areas.


Utilities & Maintenance

  • Trash: Collection is every Tuesday by the City of Tucson. All trash must be inside containers; wet garbage must be bagged.

  • Insurance: The Association carries a blanket policy (Community Association Underwriters of America). Personal property and interior liability are not covered; owners/tenants must obtain their own insurance.

  • Water Emergencies: Do not shut off sprinkler valves; contact management or a Board member immediately.

  • Paint Colors: Only approved colors are Desert Palms White and Desert Palms Brown (available at Dunn Edwards, 7525 E. Broadway).
